Re: Privacy Policy issued by Motovario S.p.A. pursuant to art. 13 of European Regulation 2016/679

Whereas

  1. As a result of your visits to this website, the submission of forms, the receipt of your requests, preliminary contacts, surveys and market research, the possible establishment of a business relationship our company will collect and process your personal data.
  2. For the sake of clarity, we hereby specify the following definitions established by European Regulation 2016/679:

    Personal data: any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

    Processing: any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

In view of the above, pursuant to art. 13 of European Regulation 2016/679, we inform you that the collection and processing of your personal data will be carried out by this company in accordance with the following

  1. General purposes: the data will be processed to respond to your requests, for the correct fulfilment of administrative, commercial, accounting, tax and technical obligations and for all business activities required by law or otherwise strictly related to existing relationships.
  2. Direct marketing purposes: exclusively subject to your free, optional, specific and explicit consent that you can withdraw at any time, your data may also be used to send advertising materials/communications by mail, email, telephone, fax, text messages and similar means. However, after having given consent it is your right to object to the processing of your data for this purpose at any time and without cost.
  3. Method: the data will be processed using paper/electronic/computer/online tools/media in full compliance with the law, according to the principles of lawfulness and propriety and in order to protect their confidentiality.
  4. Optional provision of data: the provision of your data is optional and not mandatory.
  5. Consequences of a refusal: the refusal to provide data or full opposition to processing for the purposes referred to in point a) may in any case make it impossible to satisfy certain requests. The refusal to use the data for the purposes referred to in point b), however, will not have any consequence on the recognition of benefits linked to promotions or on existing relationships.
  6. Subjects or categories of subjects (recipients) to whom the data may be disclosed or disseminated: the data may be disclosed to third parties only to fulfil legal or contractual obligations. The data will not be disseminated under any circumstances.
  7. Persons authorised to perform processing: the data will be processed solely and exclusively by a small number of specifically authorised company employees in the administrative, marketing, IT and commercial areas.
  8. Automated decision-making processes (e.g. profiling): automated decision-making processes are not managed in any way.
  9. Rights of the data subject: you enjoy all the rights established by European Regulation 2016/679, like the right to request access to personal data and their correction, erasure, restriction of processing, the right to oppose their processing, as well as the right to data portability. You also have the right to lodge a complaint with the Supervisory Authority.
  10. Transfers to third countries: any transfer of personal data to a third country outside the European Union or to an international organisation will take place on the basis of an adequacy decision of the Commission or, in the case of transfers referred to in articles 46, 47 or 49, second paragraph of the European Regulation, on the basis of appropriate guarantees.
  11. Data storage period: the data will be kept for the period strictly necessary to meet the requests of the data subject or in accordance with the provisions of current regulations or any contractual clauses.
  12. Data Controller: the data controller is Motovario S.p.A., with registered office in Via Quattro Passi 1/3, Formigine (MO), in the person of the pro tempore legal representative.
  13. Data protection officer: the person in charge of data protection is Mr Juri Torreggiani with office located at Via Piccard 16/G, Reggio Emilia, tel 0522.30.11.69, fax 0522.38.79.96. Any request for clarification or information can be sent to this person.

This policy can be supplemented either verbally or in writing with further elements and clarifications in order to best meet any need you may have for information on the subject of Privacy and to comply with regulatory developments.
