Re: Privacy Policy pursuant to art. 13 of European Regulation 2016/679 issued by Motovario S.p.A. to the applicant presenting a CV through the website

This policy is prepared and issued pursuant to art. 13 of European Regulation 2016/679 (hereinafter also European Regulation), which introduced significant regulatory changes regarding the protection of personal data.

This policy therefore updates and replaces any previous versions issued before now.

Now therefore, it should be noted that:

  1. Having received your curriculum vitae, our company will use it to collect and process your personal data.
  2. For the sake of clarity, we hereby specify the following definitions established by the aforementioned European Regulation:
    Personal data: any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
    Processing: any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Pursuant to art. 13 of European Regulation 2016/679, therefore, we inform you that the collection and processing of your personal data will be carried out in accordance with the following points:

  1. Purposes: the data will be processed for: making selections, interviews, drafting of aptitude profiles and similar, the correct fulfilment of bureaucratic and administrative obligations and for company activities in general aimed at your possible hiring, the extraction of information and comparison with the profiles of other applicants, sending correspondence.
  2. Method: the data will be processed using paper/electronic/computer/online tools/media in full compliance with the law, according to the principles of lawfulness and propriety and in order to protect their confidentiality.
  3. Optional provision of data: the provision of data is optional and not required.
  4. Consequences of refusal: the refusal to provide data or allow their processing subsequent to having read this Policy will make it impossible for us to establish and/or continue any relationship of any kind with yourself.
  5. Parties or categories of parties (recipients) to whom the data may be disclosed or disseminated: the data may be disclosed to third parties only to fulfil legal or contractual obligations and to satisfy your requests. The data will in not be disseminated under any circumstances.
  6. Persons authorised to perform processing: the data will be processed by specifically authorised staff of the human resources department and of the administration and wages office.
  7. Automated decision-making processes (e.g. profiling): automated decision-making processes are not managed in any way.
  8. Rights of the data subject: you enjoy all the rights established by the European Regulation, like the right to request access to personal data and their correction, erasure, restriction of processing, the right to oppose their processing, as well as the right to data portability. You also have the right to lodge a complaint with the Supervisory Authority.
  9. Transfers to third countries: any transfer of personal data to a third country outside the European Union or to an international organisation will take place on the basis of an adequacy decision of the Commission or, in the case of transfers referred to in articles 46, 47 or 49, second paragraph of the European Regulation, on the basis of appropriate guarantees.
  10. Data storage period: the data will be kept for the period strictly necessary to meet the requests of the data subject or in accordance with the provisions of current regulations or any contractual clauses.
  11. Data Controller: the data controller is Motovario S.p.A., with registered office in Via Quattro Passi 1/3, Formigine (MO), in the person of the pro tempore legal representative.
  12. Data protection officer: the person in charge of data protection is Mr Juri Torreggiani with office located at Via Piccard 16/G, Reggio Emilia, tel 0522.30.11.69, fax 0522.38.79.96. Any request for clarification or information can be sent to this person.

This policy can be supplemented either verbally or in writing with further elements and clarifications in order to best meet any need you may have for information on the subject of Privacy and to comply with regulatory developments.
